Snapshot:
On October 21, 2026, the OCC issued its final rule implementing key provisions of the GENIUS Act, establishing requirements for permitted payment stablecoin issuers, foreign payment stablecoin issuers under OCC jurisdiction, and certain custody activities conducted by OCC-supervised entities. The rule takes effect January 18, 2027.
The rule establishes standards covering reserve assets, redemption, risk management, audits, reporting, supervision, custody, capital, and other requirements for covered payment stablecoin activities. Importantly for financial-crime compliance teams, the OCC states that the rule does not yet address BSA/AML or OFAC sanctions requirements. Those provisions will be addressed through a separate rulemaking coordinated with the Treasury Department.
Why it Matters:
The final rule gives financial institutions greater clarity around the regulatory framework for payment stablecoins, while leaving a critical piece of the compliance picture still to come. For BSA/AML and sanctions professionals, the separate Treasury-coordinated rulemaking will be particularly important to watch as the broader stablecoin framework moves toward implementation.
